Fire Pits, Outdoor Fireplaces and What New York Actually Says

New York caps a lawful open outdoor fire at under 3 feet in height and under 4 feet in length, width or diameter, burning only charcoal or dry, clean, untreated and unpainted wood, and your own town, village, city or county may be stricter than that. The permit answer is local too: Clay and Cicero both name fireplaces on their permit lists, and neither names a patio. The footing depth is the one thing nobody can tell you from a website, because New York publishes no frost depth at all and leaves the number to your municipality.

The order to settle a fire feature in

  1. Size the fire to the rule

    State floor, local ordinance on top

    Under 3 feet high and under 4 feet in length, width or diameter, charcoal or dry clean untreated unpainted wood only. Your town may be stricter.

  2. Ask your code office two questions

    3,500 psi for exposed steps and porches, 3,000 psi for exposed vertical work, 5 to 7 percent air. Protect the pour for about two days.

Four decisions, and the first two cost nothing but a phone call.

Size the fire before anyone designs the masonry

This is the rule to settle first, because it decides the dimensions of everything built around it. The Department of Environmental Conservation states that campfires, small cooking fires, or any other outdoor fire less than 3 feet in height and 4 feet in length, width or diameter are allowed, and that all fires must consist of only charcoal or dry, clean, untreated and unpainted wood. The underlying regulation, 6 NYCRR 215.3(c), permits small fires used for cooking and camp fires provided only charcoal or untreated wood is used as fuel and the fire is not left unattended until it is out. A fire bowl 5 feet across is therefore outside the state exception no matter how well it is built or how much it cost. The same rule prohibits burning brush from March 16 through May 14. Getting this straight before the design stage costs nothing; discovering it after the stone is set is expensive and there is no version of the job that fixes it.

Your town is allowed to be stricter than the state, and some are

The state rule is a floor rather than a ceiling. The Department of Environmental Conservation says plainly that towns, villages, cities and counties can pass ordinances stricter than Part 215. That is why an answer that is correct for one address in this county can be wrong four miles away, and it is why a contractor telling you the state allows it has answered only half of the question. Before the design is fixed, look up your own municipality's ordinance on open burning and recreational fires, or ask the clerk. Where the two rules differ, the tighter one is the one that governs your yard. If your property straddles a village line, which happens more often than people expect around here, ask both offices.

Which towns here name a fire feature on their permit list

Permits in New York are administered locally, and the published lists in this metro make an unusually clear pattern. The Town of Clay lists fireplaces, stoves and inserts among the work requiring a building permit, alongside new buildings, additions and alterations, garages and barns, pools, sheds, decks and porches, fences, signs and demolition. The Town of Cicero lists fireplaces, pellet stoves and wood stoves, along with decks, porches and garages, sheds no matter the size, fences, pools and structural, plumbing or electrical alterations, and it additionally requires a permit before excavating or filling more than 10 cubic yards and a Floodplain Development Permit for any work in a 100 year flood zone. Neither town's list names a patio at grade. The City of Syracuse names retaining walls, driveways, fences, decks, porches, gazebos and pergolas, sheds and garages, and a miscellaneous category for chimney and foundation or site work, and neither its permit list nor its no-permit list mentions a patio. The Town of Manlius publishes thresholds for sheds under 144 square feet, for decks and for fencing, and publishes none for a patio. So the common shape of an outdoor living project here is a permit for the fire feature and nothing published for the paving around it. Silence on a list is not the same as permission, and zoning setbacks are a separate question that usually decides where in the yard the thing can go.

The footing question is genuinely unsettled, and here is why

Two provisions of the residential code are both true at the same time, which is the honest reason two competent masons can quote you very different footings for the same fireplace. Section R403.1.4 requires exterior footings to be placed not less than 12 inches below the undisturbed ground surface, and that is a floor before frost is considered at all. Section R403.1.4.1 then gives four ways to protect a footing from frost: extend it below the frost line specified in Table R301.2(1), build it under Section R403.3, design it to ASCE 32, or found it on solid rock. It also states that footings shall not bear on frozen soil unless the frozen condition is permanent. But the same section carries exceptions, and one of them fits a garden fire feature: frost protection is not required for free-standing accessory structures of 400 square feet or less of other than light-frame construction with an eave height of 10 feet or less. One mason reads the exception and quotes a shallow footing. Another reads the frost line route and quotes a deep one. Both can point at the code. Only your own code enforcement officer can tell you which reading they will accept on your property, and that call is the difference between two prices thousands of dollars apart.

The insulated shallow route is closed to anything unheated

One of those four frost routes can be ruled out straight away for a yard structure, which is useful to know before it is offered to you. Section R403.3, frost-protected shallow foundations, applies only to buildings where the monthly mean temperature inside is maintained at not less than 64 degrees Fahrenheit, and it states that foundations protected from frost by that method shall not be used for unheated spaces such as porches, utility rooms, garages and carports, nor attached to basements or crawl spaces not held at that temperature. An outdoor fireplace, a pizza oven, a kitchen counter run and a pillar are all unheated construction. So the routes genuinely available are the frost line depth your municipality has set, an engineered design to ASCE 32, bearing on solid rock, or the accessory structure exception above. If anyone proposes insulating a shallow footing instead of digging, that is the provision to ask them about.

New York does not publish a frost depth, so we are not going to invent one

This is the part no competitor in this market tells homeowners, and it is the most useful thing on this page. Section R301.2 of the Residential Code of New York State states that additional criteria shall be established by the local jurisdiction and set forth in Table R301.2(1), and the table's own footnote for the frost line depth column instructs the jurisdiction to fill in the minimum depth of footing below finish grade. The column is published blank. The Department of State's technical bulletin TB-1009-RCNYS confirms it: the local jurisdiction shall provide that minimum depth, and the considerations it may use include, but are not limited to, air freezing index, soil type, water table depth, local historical data and field experience. The bulletin even notes that where an authority having jurisdiction spans several municipalities, the data should be completed for each municipality individually. Soil type and water table depth are on that list, which is exactly why a figure that is right on the well drained till in Marcellus can be wrong on the somewhat poorly drained ground in Cicero. The figures that circulate online for this part of the state came from somebody's field experience, not from the code, and we will not repeat one here as though it were a rule. For reference, if an engineered ASCE 32 design is ever proposed, the Syracuse input is published: NOAA gives station 308383 an air freezing index of 1,213 degree-days Fahrenheit at the 100 year return period.

Two phone calls, and you will not need anybody to interpret them

Before you compare a single price, call your own town, village or city code office and ask two questions. What frost line depth have you filled into Table R301.2(1). And is a fire feature on your list of work requiring a building permit. Write down the answers and the name of the person who gave them. That is a short call, it is the only authoritative answer either question has, and it converts a disagreement between contractors into a fact. While you are on the phone, ask about setbacks, because in most of these municipalities zoning decides where in the yard a fire feature can sit long before the building code decides how deep it goes. If your project is in Camillus, note that the town's residential permit checklist requires the contractor's New York State Workers Compensation proof before it will issue, naming forms U-26.3, C-105.2 or GSI-105.2, with WC/DB-100 where a contractor has no employees and BP-1 where the homeowner is doing the work. Paperwork that stalls in September turns a September build into a November one, with everything that implies for cold weather procedure.

The concrete under it, and the month it is poured

A footing is concrete before it is masonry, and in this state the exposure category is not a choice. The Department of State bulletin states that under Figure R301.2(4) New York is entirely within the Severe weathering probability category, the worst of the three, and Severe is what drives Table R402.2. In that category, porches and steps exposed to the weather require a minimum specified 28 day compressive strength of 3,500 pounds per square inch, and basement, foundation and other exposed vertical concrete requires 3,000, with total air entrainment of not less than 5 percent and not more than 7 percent by volume in those exposed locations. Air entrainment is the one specification here that is invisible, cheap to omit and impossible to verify afterward, so the sensible move is to ask for the delivery ticket on the day. Timing matters too: fresh concrete freezes below about 25 degrees Fahrenheit, frozen concrete can lose more than half its potential strength and will not be durable, and it wants protection until it reaches 500 pounds per square inch, roughly two days after placement. A late autumn footing is entirely possible with covers and heat, and entirely ruined without them.

When you do not need masonry at all

If what you actually want is somewhere to sit around a fire on paving you already have, buy a portable fire bowl, check your municipality's ordinance on recreational fires, keep it inside the state's dimensions and fuel rule, and spend nothing else. No footing, no permit question, no frost depth, no contractor. A great many people who start out pricing a built fireplace end up wanting that, and they find out after they have paid for a design. Equally, if the thing you want built is really a seat wall holding back a bank of earth, that is a retaining wall and a structural job rather than an outdoor living build, and it belongs with a trade that repairs and builds structural walls.

Get your code office's two answers first, then send us what you have in mind: roughly what you want built, where in the yard it goes, wood or gas, and the dimensions of the fire itself. We pass it to licensed, insured masons, and knowing your municipality's frost depth before you compare prices is what makes their numbers mean something. There is no obligation. Both of the fast-growing northern towns name fireplaces on their list of work requiring a building permit and neither names a patio. The Town of Clay lists new buildings, all additions and alterations, mobile homes, garages and barns, pools, sheds and storage buildings, decks and porches, fences, signs, fireplaces, stoves and inserts, and demolition. The Town of Cicero lists decks, porches and garages, fireplaces, pellet stoves and wood stoves, storage sheds no matter the size, fences, swimming pools, and structural, plumbing or electrical alterations, and requires a permit before excavation or filling of more than 10 cubic yards. Cicero also requires a Floodplain Development Permit for any work in a 100 year flood zone, including work that would not otherwise need a permit.

The City of Syracuse issues residential construction permits for one and two family homes and names the work that needs one, including retaining wall, driveway, fence, deck, porch, gazebo and pergola, shed and garage, and a miscellaneous category covering chimney and foundation or site work. Its published list of work needing no permit includes sealing or adding an additional layer of tarvia to a driveway, but does not include building a new driveway. Neither list names a patio at grade.

The Town of Manlius publishes specific thresholds. Any shed or playscape less than 144 square feet does not need a building permit, although the setback requirements for each zone still apply. Deck construction requires a building permit whether the deck is affixed to a structure or stands alone, while replacing rotted flooring, stair treads, railing tops and side spindles and general cosmetic repairs do not. The town states that it does not regulate fencing on private or commercial property unless the fencing relates to a swimming pool, hot tub or spa. No threshold is published for a patio at grade or for a retaining wall.

The Town of Camillus residential building permit checklist requires proof of New York State Workers Compensation insurance for the contractor performing the work, naming the acceptable forms as U-26.3 from the New York State Insurance Fund, C-105.2 or GSI-105.2, and allowing form WC/DB-100 where a contractor has no employees, or form BP-1 where the homeowner is doing the work themselves. The same checklist requires a driveway permit from Onondaga County Department of Transportation, the Town of Camillus Highway Department or New York State Department of Transportation depending on the road, and a Phase II stormwater permit if one or more acres will be disturbed during construction.

Section R403.1.4.1 carries three exceptions to the frost protection requirement. The shallow insulated foundation route is closed to outdoor structures. Section R403.3, Frost-Protected Shallow Foundations, applies only to buildings where the monthly mean temperature of the building is maintained at not less than 64 degrees Fahrenheit, and states that foundations protected from frost in accordance with Figure R403.3(1) and Table R403.3(1) shall not be used for unheated spaces such as porches, utility rooms, garages and carports, and shall not be attached to basements or crawl spaces not maintained at that temperature.

The air freezing index is one of the inputs New York names for setting a local frost depth, and NOAA publishes it by station. For Syracuse WSO, station 308383 at 43 degrees 07 minutes north, elevation 410 feet and a mean annual temperature of 47.7 degrees Fahrenheit, the air freezing index at the 100 year return period is 1,213 degree-days Fahrenheit. The 2 year value is 744 and the 50 year value is 1,163.

The same Technical Bulletin states that the weathering column of Table R301.2(1) shall be filled in with the weathering index obtained from Figure R301.2(4), and that according to the figure New York State is completely within the Severe weathering probability category. Table R402.2 of the Residential Code of New York State sets the minimum specified 28 day compressive strength of concrete by weathering potential. In the Severe category, which covers all of New York State, porches and steps exposed to the weather and garage floor slabs require 3,500 pounds per square inch, and basement walls, foundation walls, exterior walls and other vertical concrete work exposed to the weather require 3,000 pounds per square inch. Concrete in those exposed locations shall be air-entrained with a total air content of not less than 5 percent and not more than 7 percent by volume.

The footing concrete under new masonry has its own cold weather rules. The National Ready Mixed Concrete Association defines cold weather as a period when the average daily temperature is below 40 degrees Fahrenheit for more than three consecutive days and the air temperature is not above 50 degrees for more than half of any 24 hour period. It states that fresh concrete freezes if its temperature falls below about 25 degrees Fahrenheit, that the potential strength of frozen concrete can be reduced by more than 50 percent and it will not be durable, and that concrete should be protected from freezing until it reaches 500 pounds per square inch, about two days after placement.

In the Town of Cicero, 59.5 percent of the mapped soil area is classed poorly drained, somewhat poorly drained or very poorly drained, and 6.2 percent is classed well drained. The single largest map unit is Niagara silt loam on 0 to 4 percent slopes at about 28.6 percent of the town, followed by Collamer silt loam at about 12.2 percent and Carlisle muck, a very poorly drained organic soil, at about 12.0 percent.

In the Town of Marcellus, 10.6 percent of the mapped soil area is classed poorly drained, somewhat poorly drained or very poorly drained, and 61.9 percent is classed well drained. Honeoye silt loam accounts for about 25.2 percent of the town on 3 to 8 percent slopes and about 12.5 percent on 8 to 15 percent slopes, with Lima silt loam at about 7.6 percent. Honeoye is well drained hydrologic group B with a seasonal water table about 30 inches down.
